Terms of Service

1. Agreement to Terms

By accessing or using MyClaw ("the Service"), operated by MyClaw ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

MyClaw provides agentic AI computing as a service. We provision dedicated virtual machine instances on Google Cloud Platform (GCP) that run AI-powered agents connected to your communication channels (Discord, Telegram, Slack, SMS). Each instance is isolated and dedicated to your account.

3. Account Registration

You must sign in with a valid Google account to use the Service. You are responsible for maintaining the security of your account and all activity that occurs under it. You must be at least 18 years old to use the Service.

4. Subscriptions and Billing

The Service is offered on a monthly subscription basis. Prices are listed on our pricing page and may change with 30 days' notice. All payments are processed securely through Stripe. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months, but you retain access to your instance until the end of the paid period.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Generate, distribute, or facilitate spam, phishing, malware, or any form of abuse
• Harass, threaten, or impersonate others
• Attempt to gain unauthorized access to other users' instances or our infrastructure
• Use the AI agents to produce content that violates Anthropic's Acceptable Use Policy
• Resell or redistribute the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these terms. Where possible, we will provide notice and an opportunity to remedy the violation before taking action.

6. Your Content and Data

You retain full ownership of all content you create, configure, or transmit through the Service, including your Soul configuration, agent identities, and conversation data. We do not claim any intellectual property rights over your content. You grant us a limited license to host and process your content solely for the purpose of providing the Service to you.

7. Instance Management

Each MyClaw instance runs on a dedicated GCP virtual machine. We manage the infrastructure, including provisioning, monitoring, and maintenance. We may perform updates or maintenance that temporarily interrupts service; we will provide reasonable notice for planned maintenance. You can export your instance data at any time through the dashboard.

8. Third-Party Services

The Service integrates with third-party platforms including Discord, Anthropic (Claude AI), Google Cloud Platform, and Stripe. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability or behavior of third-party services.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided "as is" and "as available." We are not liable for any downtime, data loss, or damages arising from service interruptions, whether caused by maintenance, infrastructure failures, or events beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, MyClaw shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless MyClaw, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the billing portal. We may terminate or suspend your access for violation of these Terms with reasonable notice. Upon termination, your instance will be shut down and data deleted within 30 days unless you export it beforehand.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
